Our firm participated in one of the largest class action settlements in South Carolina history. The case was brought on behalf of Santee Cooper electricity ratepayers who had been forced to finance, through rates, two new nuclear power plants that were eventually abandoned due to incompetence and misconduct.
We analyzed troves of complex construction documents and communications, formulated legal arguments attacking Santee Cooper’s claim that it could charge ratepayers for any costs it incurred – no matter what – and chased down millions of dollars in insurance coverage. After years of hard-fought litigation, the case ultimately settled on highly favorable terms for the class.
The settlement involved, among other things, a $520 million payout and an agreement by Santee Cooper not to raise electricity rates for several years. We are proud of our involvement in this landmark case, which held a very powerful state agency accountable to its ratepayers and the entire State of South Carolina.
