Our client purchased a dry-stack marina along Shem Creek. After acquiring the property, plans were drawn up to convert an existing structure on the property to a low-key marina store. For months, the Town staff objected to these plans, claiming this use was not allowed. We successfully negotiated a positive resolution for the client without resort to any litigation by convincing the Town’s staff that the use was a permitted, accessory use to the dry-stack marina under South Carolina case law and the Town’s zoning ordinances.
