Our client was a successful businessman who left the employ of his employer in the securities industry after many years. His employer sued him, claiming that he was violating the covenants contained in his employment agreements while working with a new employer.
Our approach was to critically analyze what the dated employment agreements prevented our client from doing and compare those prohibitions to our client’s allowable activities and synthesize those differences.
While this matter resulted in significant litigation, we were able to prevent the entry of injunctive relief. Armed with our analysis, we showed the employer’s counsel that there were no violations of any covenants. Soon thereafter, we resolved the case positively for our client
